SMS Terms and Privacy

These SMS Terms and Privacy (the “SMS Terms”) govern the text message program (the “Program”) offered by Ervin Innovations LLC d/b/a StopBox USA (“StopBox,” “we,” “us,” or “our”). The Program is operated with the assistance of our messaging provider. These SMS Terms supplement and form part of our Privacy Policy and Terms of Service. By enrolling in or using the Program, you agree to these SMS Terms.

The Short Version

  • By providing your mobile number and opting in, you consent to receive recurring automated marketing and transactional text messages from StopBox.
  • Consent is not a condition of any purchase.
  • Message frequency varies. Message and data rates may apply.
  • Reply STOP to cancel at any time. Reply HELP for help.
  • These SMS Terms include an arbitration agreement and class action waiver (Section 13), with a right to opt out of arbitration.

1. The StopBox SMS Program

The Program allows you to receive text messages from StopBox, which may include marketing and promotional messages (such as offers, product news, and cart reminders) and transactional messages (such as order and shipping updates). Messages may be sent using automated technology.

2. Consent and Opt-In

You enroll in the Program by providing your mobile telephone number and agreeing to receive text messages, for example by submitting your number through a sign-up form, at checkout, or by texting a keyword to us. When you opt in, you represent that you are the subscriber to, or the customary user of, the mobile number provided, and that you are authorized to enroll that number.

Your consent to receive marketing text messages is not a condition of purchasing any goods or services from StopBox.

3. Message Frequency

Message frequency varies based on your interactions with StopBox and on current promotions.

4. Message and Data Rates

Message and data rates may apply to each message sent to you or sent by you to us, according to the plan provided by your wireless carrier. Please contact your carrier for pricing details. StopBox is not responsible for any message or data charges you incur.

5. Opting Out

You may cancel your participation in the Program at any time by replying STOP to any message you receive from us, or by texting STOP to the applicable Program number. After you send STOP, we may send you a single message confirming your cancellation. Following that confirmation, you will no longer receive marketing text messages from the applicable Program. You may continue to receive transactional messages related to existing orders, and you may receive messages from any other StopBox program you have separately joined.

7. Eligibility

The Program is available to residents of the United States who are 18 years of age or older. By enrolling, you represent that you meet these requirements.

8. Carriers and Delivery

Wireless carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your wireless carrier and is not guaranteed. The Program may not be compatible with all wireless carriers or devices.

9. Changes to the Program or These SMS Terms

We may change or terminate the Program, or update these SMS Terms, at any time. Changes are effective when posted. Your continued participation in the Program after changes are posted constitutes your acceptance of the updated SMS Terms.

10. Information We Collect Through the Program

In connection with the Program, we collect your mobile telephone number, your opt-in and opt-out records, your responses and interactions with our messages (such as clicks and replies), and related metadata provided by your carrier or our messaging provider. This information is handled in accordance with our Privacy Policy.

11. How We Use and Share SMS Information

We use the information described above to operate the Program, send the messages you have requested, measure engagement, provide support, and comply with law. We share this information with our messaging provider and other service providers who help us operate the Program, and with carriers as needed to deliver messages.

We do not sell or share your mobile opt-in information, and we do not share the phone number you provide to the Program with third parties for their own marketing purposes. All consent to receive text messages from StopBox is kept within StopBox and its service providers.

12. State-Specific Provisions

Some states have laws that apply specifically to text message and telephone solicitation programs. The following provisions apply to residents of those states. We determine your state of residence based on the information you provide and, where applicable, the area code of the mobile number you enroll.

  • Florida. Consistent with the Florida Telephone Solicitation Act, by enrolling you provide your prior express written consent to receive automated marketing text messages from StopBox at the number you provide. You may withdraw consent at any time by replying STOP.
  • Washington. Consistent with the Washington Commercial Electronic Mail Act, you consent to receive commercial text messages from StopBox at the number you provide, and you may withdraw consent at any time by replying STOP.
  • Oklahoma. Consistent with the Oklahoma Telephone Solicitation Act, by enrolling you provide your prior express written consent to receive automated marketing text messages from StopBox at the number you provide. You may withdraw consent at any time by replying STOP.
  • California. California residents may exercise the privacy rights described in our Privacy Policy with respect to information collected through the Program.

13. Dispute Resolution, Arbitration, and Class Action Waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have disputes decided by a jury or as part of a class action.

Informal resolution first. Before initiating arbitration, you agree to first contact us at support@stopboxusa.com and provide a brief description of the dispute and your contact information. The parties will attempt in good faith to resolve the dispute for sixty (60) days after notice.

Agreement to arbitrate. If the dispute is not resolved, you and StopBox agree to resolve any claim arising out of or relating to the Program or these SMS Terms through final and binding individual arbitration, rather than in court, except as set out below. The arbitration will be administered by a recognized arbitration provider under its consumer arbitration rules.

Class action waiver. You and StopBox agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of a representative or class proceeding.

Jury trial waiver. You and StopBox waive any right to a jury trial for any claim subject to arbitration under these SMS Terms.

Your right to opt out of arbitration. You may opt out of this arbitration agreement by emailing support@stopboxusa.com with the subject line “Arbitration Opt-Out” within thirty (30) days after you first accept these SMS Terms. Your notice must include the mobile number enrolled in the Program. If you opt out, the arbitration and class action waiver provisions will not apply to you, and the remaining provisions of these SMS Terms will continue to apply.

Exceptions. Nothing in this section prevents either party from bringing an individual claim in small claims court, or from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights. Nothing in this section waives any right to seek public injunctive relief to the extent that right cannot be waived under applicable law.

Severability. If any portion of this section is found unenforceable, that portion will be severed and the remainder will continue to apply, except that if the class action waiver is found unenforceable as to a particular claim, that claim will proceed in court.
